1. Acceptance of terms

By accessing or using Spectra (spectrabolt.com), you agree to be bound by these Terms of Service. Spectra is operated by Perigeon Software LLC (USA) and Perigeon Software Private Limited (India); the specific entity you contract with depends on the currency you choose for billing, as set out in section 2 below. If you do not agree with any part of the terms, you may not access or use the Service. Your continued use of Spectra constitutes acceptance of these terms and any future updates.

2. Who you are contracting with

Depending on your geographic location and the currency you choose for billing, you are entering into a legally binding agreement with one of two entities:

• USD transactions: You are contracting with Perigeon Software LLC, a company incorporated in the State of Delaware, USA (“Spectrabolt US”). Spectrabolt US acts as the official Merchant of Record for all USD-denominated accounts.
• INR transactions: You are contracting with Perigeon Software Private Limited, a company incorporated under the laws of India and based in Ahmedabad, Gujarat (“Spectrabolt India”).

3. Description of service

Spectra provides monitoring for websites, APIs, servers, SSL certificates, and scheduled jobs. The platform periodically checks the targets you configure, records availability and performance, and notifies you when issues are detected. We may add, modify, or remove features at any time.

4. Intellectual property

All right, title, and interest in and to Spectra (spectrabolt.com) — including but not limited to software code, website design, core algorithms, logos, trademarks, and documentation — are the exclusive property of Perigeon Software Private Limited, based in India. Your subscription grants you a limited, non-exclusive, non-transferable license to access the Service. No intellectual property rights are transferred to you, or to any regional reseller affiliate, through these Terms.

5. User responsibilities

By using Spectra, you agree to:

• Provide accurate and complete information when creating an account.
• Maintain the confidentiality and security of your account credentials.
• Only monitor services that you own or have permission to monitor.
• Use the Service in compliance with all applicable laws and regulations.
• Ensure your use of the Service does not negatively impact other users or systems.

6. Acceptable use

You agree not to use the Service to:

• Violate any applicable laws or regulations.
• Infringe upon the intellectual property rights of others.
• Distribute malware, malicious scripts, or harmful software.
• Disrupt, overload, or interfere with the Spectra infrastructure.
• Monitor or interact with systems without proper authorization.

7. Service availability

We strive to maintain a reliable platform and aim for high service availability. However, Spectra does not guarantee uninterrupted or error-free access at all times. We reserve the right to modify, suspend, or discontinue any part of the Service temporarily or permanently without prior notice.

8. Changes to these terms

Spectra may update these Terms of Service from time to time. When changes are made, the "Last updated" date at the top of the page will be revised. Your continued use of the Service after updated terms take effect constitutes acceptance of the updated terms.

9. Governing law & disputes

The governing law of this agreement depends on your contracting entity:

• If your contract is with Perigeon Software LLC (USD accounts), these Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict-of-law principles, and any legal actions must be filed in the courts of the State of Delaware.
• If your contract is with Perigeon Software Private Limited (INR accounts), these Terms are governed by the laws of India, and any disputes fall under the exclusive jurisdiction of the competent courts located in Ahmedabad, Gujarat, India.
